Melbourne Terms & Conditions

Please read the following Terms and Conditions carefully before placing your order with us.

In these Terms and Conditions any reference to “we”, “our”, “us” means Cakes of Distinction & Sweet Affection Cake Designs.

Any reference to “you”, “your”, “your representative” means the customer or purchaser of our goods and services.

We reserve the right to refuse any order at our discretion.

By proceeding with an order (as evidenced by the payment of the deposit) you agree to be bound by these Terms and Conditions.



A non-refundable deposit of 50% of the total cost of the order is required to confirm your order. Payment of the deposit can be made by cash or electronic transfer of funds into our nominated bank account. EFTPOS facilities are also available.



All cancellations must be received in writing and within the following notification periods:

  • wedding cakes no less than 12 weeks prior to the delivery date;
  • all other cakes no less than 4 weeks prior to the delivery date.

A refund of the deposit is not available for cancellations. We will however agree to deliver your order at an agreed deferred date or apply the deposit as a credit towards a new order if your cancellation is received within the notification period specified above.

If a cancellation is required due to unforeseen circumstances beyond your control outside of the notification period a refund of the deposit is not available. We will however agree to deliver your order at an agreed deferred date or apply the deposit as a credit towards a new order.



The balance of the payment is due 14 days prior to delivery. Payment of the balance can be made by cash or electronic transfer of funds into our nominated bank account. EFTPOS facilities are also available.

We reserve the right to revisit pricing if postponed.

Work on orders will not begin unless paid in full.


Third Party Arrangements

Third parties (such as wedding planners and reception venues) must confirm their order no less than 12 weeks prior to the delivery date by paying a non-refundable deposit of 50% of the total cost of the order. Payment terms for Third parties with approved monthly accounts are 7 days from delivery.


Your Order

Upon confirmation of your order, you or your representative will need to agree to colours, designs, sizes, servings and flavours.

Any changes required by you are to be made in writing no later than 30 days prior to delivery. We will do our best to accommodate such changes where possible.

You or your representative agree that upon delivery, the cake will be accepted ‘as is’ and as ordered.

Whilst we will do our best to replicate inspiration, pictures and ideas provided by you or your representative, we reserve the right to use creative judgment or make adjustments where we feel necessary. We do this to maintain the quality and workmanship of our designs and preserve the interpretation of your design to the best of our abilities.

Our own designs may also vary slightly from cake to cake.

The size of each portion will be adjusted to accommodate the correct number of servings based on an industry standard slice 1“ x 1” x 5” tea and coffee servings and 1”x 2”x 3” industry standard dessert portions. However, some designs may require a taller cake and portions may end up being either smaller or larger. We will always communicate serving sizes to you. We will not be held responsible for shortage of cake due to incorrect guest counts or incorrect cutting and serving of the cake by the venue. We will communicate with the venue to ensure that they are given details of the number of serves and structural supports, or if any part of the overall design is not to be cut.


Allergic Reactions

Our products may contain or come in contact with nuts, soy, milk, wheat and other items that cause allergic reactions.

Whilst every precaution will be taken in the cases of known allergies, you agree to advise your guests or anyone else who may come into contact with our products of the possibility of allergic reactions.

You agree to indemnify us absolutely for any allergic reactions that may occur.

Supplying your own decorations/fresh flowers:

  • If fresh flowers are provided to be used on the order, you or your representative acknowledge that fresh flowers are not a food product and may contain pesticides, insects, dirt and other contaminants and can cause the cake to become inedible. Flowers will be wired and taped and inserted into the cake through straws or flower picks. Water vial picks provided by florists must be completely waterproof so as water does not enter the cake at any time.

We reserve the right to refuse any item that we deem not to meet health and safety standards.

We accept no responsibility for any items placed on a cake by a third party which render the cake inedible. All inedible items must be removed by the venue prior to cutting and serving and you agree to notify the venue of this.



We reserve the right to take and use photographs of your cake for marketing and promotional purposes without compensation to you.


Equipment Hire

A hire fee will be charged for any hire equipment delivered with the cake. Payment of a bond for the hire equipment is also required.

All hired equipment must be returned within 3 days of the delivery date.

You are responsible for all hired equipment including cost of replacing same in the event of loss or damage.



The delivery fee will be based on our hourly rate and the time it takes us to drive to and from your venue, time to set up your cake at the venue, Linkt freeway charges & paid parking if applicable.

All care is taken by us to ensure your cake is delivered in optimum condition. We accept no responsibility for loss or damage to your cake or decorations outside our possession including:

  • any deterioration as a result of the cake not being stored at a suitable temperature;
  • mishandling by guests and venue staff;
  • damage in transit where you or your representative has collected the cake.

If no one is available to accept your order at the scheduled time of delivery, it will be left outside of the delivery address.
